Terms of Service

1. Acceptance of Terms

By accessing or using clstr (clstr.life), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the service. Your continued use of clstr after any changes to these terms constitutes your acceptance of the updated terms.

2. Description of Service

clstr is a media-sharing platform that allows you to create a personalized profile, upload and organize photos and videos into collections called “clstrs,” and share them with others through your unique subdomain. The service includes features such as image processing, video transcoding, invite-based collaboration, and public sharing via personalized URLs.

3. Eligibility

You must be at least 13 years of age to create an account or use clstr, in compliance with the Children’s Online Privacy Protection Act (COPPA). You must also have a valid Google account to sign up, as Google OAuth is the sole authentication method. By using clstr, you represent and warrant that you meet these eligibility requirements.

4. User Accounts

Accounts are created through Google OAuth authentication. Each individual may maintain only one clstr account. You are responsible for all activity that occurs under your account and agree to notify us immediately if you believe your account has been compromised. We reserve the right to reclaim usernames that are inactive, misleading, or that infringe on the rights of others.

5. User Content and Ownership

You retain full ownership of all photos, videos, and other content you upload to clstr. By uploading content, you grant clstr a limited, non-exclusive, royalty-free, worldwide license to store, process, transform, display, and distribute your content solely as necessary to provide and operate the service. This includes image resizing and optimization, video transcoding, serving content through our content delivery network, and displaying your media on your profile and clstr pages. This license exists only for the purpose of operating the service and terminates when you delete the content or your account.

You represent and warrant that you have all necessary rights, licenses, and permissions to upload content to clstr. You are solely responsible for the content you upload. You must not upload content that is illegal, infringes on the intellectual property rights of others, contains explicit or obscene material, is harmful or threatening, or violates the rights of any third party.

6. Prohibited Conduct

You agree not to use clstr in any manner that harasses, threatens, or intimidates other users. You may not upload spam, malware, viruses, or any harmful code. Impersonating another person or entity is strictly prohibited. You may not attempt to reverse engineer, decompile, or disassemble any part of the service, nor may you circumvent or interfere with any security features. Using automated means to access or interact with the service without our prior written permission is not allowed. You may not use the service for any unlawful purpose or in any way that could damage, disable, or impair the service.

7. Group and Event Clstrs

When you create a clstr and invite others to contribute, you are responsible for managing that clstr and its content. Contributors retain full ownership of the content they individually upload. As the creator of a clstr, you may set media limits on event-type clstrs and manage contributor access through invite links. Clstr creators may remove contributed content from their clstrs, but doing so does not affect a contributor’s ownership of their original files.

8. Intellectual Property

The clstr name, logo, visual design, and underlying source code are the exclusive property of clstr and are protected by applicable intellectual property laws. You may not use, reproduce, or distribute any of our intellectual property without our prior written consent.

9. Termination

We may suspend or terminate your account at any time if we reasonably believe you have violated these Terms of Service, or if your conduct is harmful to other users, to us, or to third parties. You may delete your account at any time through the service. Upon account deletion, all associated data, media files, and profile information will be permanently removed from our systems.

10. Disclaimers

The service is provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the service will be uninterrupted, secure, or error-free. We do not guarantee the preservation of any data or content uploaded to the service. You use the service at your own risk.

11. Limitation of Liability

To the maximum extent permitted by applicable law, clstr and its owners, operators, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or loss of goodwill, arising out of or in connection with your use of or inability to use the service. Our total aggregate liability for any claims arising from or related to the service shall not exceed the amount you have paid us, if any, in the twelve months preceding the claim.

12. Changes to Terms

We reserve the right to modify these Terms of Service at any time. When we make changes, we will update the “Last updated” date at the top of this page. Your continued use of clstr after any modifications constitutes your acceptance of the updated terms. We encourage you to review these terms periodically.

13. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the State of Washington, United States, without regard to its conflict of law provisions. Any disputes arising from or relating to these terms or the service shall be resolved in the courts of the State of Washington.
